Child Custody Guidelines
While child custody and
visitation law vary from state to state, the factors considered by the courts are very similar in
principle, namely what is in the best
interests of the child.
In California child custody cases, for example, the court has the power to
make an order for the custody of a a minor "that
seems necessary or proper." CA Family Code § 3022. In
doing so, the courts are guided by several basic statutory principles.
Some of these legal principles include, but are not limited to the following:
Safety & Welfare: Of primary concern is the child's health, safety and
welfare.
Frequent and
continuing contact: Also of great importance in
determining child custody, the courts prefer frequent and continuing contact
with both parents and shared parenting. CA Family Code § 3011, CA Family
Code § 3020(b).
